The Beneficiary hereby releases, indemnifies, and holds ABC, its affiliates and any of their representatives (collectively, the “Indemnified Parties”) harmless from and against any and all liabilities and expenses of any kind or nature arising out of any action or omission on the part of an Indemnified Party in its performance of its obligations under this Agreement or its activities in respect of the Construction of the House, this Agreement or *otherwise*.

“Otherwise” refers to the “activities” of the “Indemnified Parties.” The Beneficiary is being asked to release the “Indemnified Parties” from any responsibility for any action whatsoever taken by the “Indemnified Parties,” not merely “in respect of the Construction of the House, this Agreement” but in regard to any action taken by the “Indemnified Parties” in regard to anything.
